DECLARATION OF CONSENT FOR THE PROCESSING OF PERSONAL DATA OF CUSTOMERS

This statement, prepared by Bio Desafios, Lda, with its located in Rua 25 de Abril, 45ª Companheira, 8500-321 Portimão, enrolled in Loulé Commercial Registry Office, with Registration Number and legal person 508 155 690, telephone 282476686, e-mail: rgpd@merceariabio.pt, (here in after referred to as Company), certifies a free, clear and informed consent for the Treatment of Personal Data of Clients.

Purpose of the treatment

The personal data of the clients are received and treated by the Company for the following purposes:

- Invoicing and Customer Charges;
- Customer registration on the website, at www.merceariabio.pt;
- Inform the Client of new services available in the website, event disclosure, updated information about the company activity and, in a general mode, for marketing effects of the Company, by any means of communication, including electronic support;
- Regular submission of information not previously indexed through the Company’s Newsletter, by having the Client, the option to choose at act of registering, to receive a or declinethe newsletter, receive the same;
- Ensure that the webite meets Customer's needs by developing and publishing content, in the most appropriate way possible, to the research needs and functionality of the website.

The processing of personal data shall not cover:

- racial or ethnic origin;
- political opinions;
- Religious or philosophical beliefs;
- Union membership;
- Genetic data;
- Biometric data;
- Health Information
- data relating to the person's sexual life or sexual orientation.

Legitimacy

The legitimacy for the treatment of the data collected is a measure of the customer's consent, which is expressly provided.

Data recipients

The Company does not transfer the contact details to third parties that are not included in the previous list. If there is a legitimate basis for its transfer, the Client will be informed in advance, the identity of the recipients and the purpose of the processing of the transferred data.

The transfer occurs only when third parties present sufficient warranties for the execution of appropriate technical and organizational measures, in order that the treatment satisfies the requirements and obligations arising from the applicable legislation in data protection and ensure the defense of the rights to make the data holders.

For purposes of the foregoing,the Client authorizes the Company to collect, register, organize, preserve, adapt, alter, recover, consult, use, limit, erase or destroy the following Personal Data in automated total systems or partially in non automated systems contained in files, whether classified by itself or received by the Company to obtain a good performance of its management activities or compliance with legal obligations:

- Name
- Full address (with the resident postal code, city and country);
- Date of birth;
- Tax Identification Number;
- Phone number;
- E-mail address.

Data collection

The Company can collect directly or indirectly information (that is, through partner entities or third parties). The collection can be made through the following channels:

- Direct collection: in person, by phone, by e-mail and through the website;
- Indirect collection: through official partners and subjects.

Personal data may be collected in various circumstances, including (but not limited to) the following:

1. Participation in marketing programs (subscription of newsletters, contribution in surveys and / or comments)

DATA PRESERVATION PERIOD

The Company is authorized to store and retain all data requested by the Customer for a period of one year, after the Client has no relation with the Company plus the time of six months to proceed to its elimination, or a exceeded time in case it is needed to use in court proceedings.

Data security

We adopt measures and techniques to protect Client’s personal data, store in our IT systems against loss, destruction, unauthorized access, change or disclosure.

Rights

The Client has the right to have free access to the data retained, as well as to request its limitation, rectification, opposition or deletion when, among other legal grounds, the data is inaccurate or no longer necessary for the purposes that motivated its collection. The Client also has the right to remove his consent at any time, without compromising the lawfulness of the treatment made based on the consent previously given.

If technically possible, you can request the portability of your data to another controller, in this case they will only be kept for the exercise or defense of complaints.

When exercising some of the aforementioned rights, the Company reserves the right to keep the data exclusively for the purposes of declaration, exercise or defense of a right in a judicial process.

The Company only transfers the contact data collected to the entities identified above.

These entities are obliged, by virtue of an agreement to this effect, to provide and maintain sufficient guarantees for the implementation of appropriate technical and organizational measures, so that the treatment satisfies the requirements and obligations arising from the applicable data protection legislation and ensures the rights of the data subject.

If there is a legitimate basis for its transfer, the Client will be informed in advance, and the identity of the recipients and the purpose of the processing of the transferred data will be transmitted to him.

STATEMENT OF AUTHORIZATION

The express consent to the processing of data is exercised upon registration of the Customer on the website www.merceariabio.pt or www.merceariabio.com through the express acceptance made in the field for that indicated effect, through which the Client also declares to have been duly informed of all obligations and liabilities inherent in the authorization granted for the collection, processing and use of your personal data to Bio Desafios, Lda., in the context described above, and this authorization may be removed at any time.
